Terms of Service

These Terms of Service (“Terms”) govern the relationship between So Fresh So Clean Home Services (“Company,” “we,” “us,” or “our”) and the customer (“Customer,” “you,” or “your”) for the provision of air duct cleaning, Aeroseal duct sealing, and related HVAC maintenance services (the “Services”). By scheduling or purchasing our Services, you agree to be bound by these Terms.

1. Scope of Services

  • Air Duct Cleaning: We will perform cleaning of the HVAC system components as specified in your service quote, typically following NADCA standards to ensure components are “Visibly Clean”.
  • Aeroseal Sealing: This process involves pressurized sealing of leaks from the inside of your ductwork using a proprietary sealant.
  • Inspections: Services include an initial assessment and, for Aeroseal, a diagnostic pre-test and post-seal certificate to verify results.

2. Customer Responsibilities

  • Access: You must provide safe and unobstructed access to the property, all air registers, and the HVAC unit at the scheduled time.
  • Preparation: Prior to our arrival, please remove valuables and breakables from the work area. We recommend covering sensitive electronics during the Aeroseal process.
  • Pre-existing Conditions: You must disclose any known hazards (e.g., asbestos, mold) or mechanical faults in the HVAC system. We are not responsible for damage arising from undisclosed pre-existing conditions.

3. Payment and Fees

  • Due Date: Payment is due in full upon completion of the service.
  • Late Payments: Payments received 15+ days after completion may be subject to interest charges.

4. Warranties and Guarantees

  • Workmanship: We warrant that all work will be performed in a professional, workmanlike manner.
  • Aeroseal Product Warranty: The Aeroseal sealant itself typically carries a 10-year manufacturer’s warranty for residential systems.
  • Limitations: We do not guarantee the total elimination of all odors or allergens, nor can we guarantee adherence of Aeroseal sealant if ducts are excessively dirty and cleaning was declined.

5. Limitation of Liability

  • Exclusions: We are not liable for indirect, incidental, or consequential damages (e.g., lost energy savings, business interruption).
  • Maximum Liability: Our total liability for any claim shall not exceed the total amount paid by the Customer for the specific service in question.
  • Property Damage: We are not responsible for the failure of aged or improperly installed HVAC components during the standard cleaning or sealing process.

6. Cancellations and Refunds

  • Notice: Cancellations must be made at least [Number] hours in advance to avoid a service fee.
  • Refunds: No refunds are provided for completed work where the dissatisfaction is based on subjective preferences or results not promised in writing.

7. Governing Law

These Terms shall be governed by the laws of the State of Utah.
